Terms and conditions of sale

These terms govern sales of wall maps concluded on larosedeslangues.com with a consumer. They are accepted at the time of the order; the version that applies is the one online on that day. Only the French version is authoritative; the English summaries are given for your convenience.

2. The maps

The maps sold are those of the catalogue, printed one at a time, to order, on fine-art matte paper of 189 to 200 g/m², unframed, in the sizes and languages offered on their page.

The preview shown on screen is faithful to the design; printed colours may differ from it slightly depending on your screen and on the paper.

What a map is. The map is a decorative and educational object. It is computed from public geographic data (see the legal notice), then simplified to remain legible: outlines, borders, relief, place names, their translations and language areas are shown in broad strokes, as the data stood when the map was made. They may contain approximations, errors or outdated information, and the map must not be used for finding your way, for navigation, or to establish any legal or administrative fact. The drawing of a border or the name given to a disputed territory expresses no political position. An approximation of this kind is not a lack of conformity; a map that is badly printed, damaged or different from the one ordered is, and is covered by section 6.

3. Prices and payment

Prices are shown inclusive of all taxes, printing and delivery included, in euros or converted into the currency you have chosen. The amount displayed is the amount that will be charged: nothing is added to it before you confirm. A wall map falls under the standard rate, 20% in France; outside the European Union the sale is exempt from French VAT, and any import duties and taxes remain payable by the recipient. The amount excluding tax, the VAT rate and the VAT amount appear on the invoice. Payment is made by card on Stripe's secure page; your card details never pass through our server. The contract is concluded when Stripe confirms the payment. An invoice is sent to you by email and remains downloadable from the order tracking page.

4. Production and delivery

The map is checked, then printed by the partner printer nearest to the delivery address (Prodigi, Printful, Gelato or Cloudprinter), who ships it rolled in a tube. It is delivered in the countries offered on the delivery page, where the workshop and the estimated time are shown before payment.

One email confirms the order, then another gives the carrier and the tracking number as soon as it is dispatched. Every step can be followed on the tracking page whose address appears in those emails.

If the map is not delivered within the stated time — or within thirty days of the order where no time has been stated —, you may ask us to deliver within a further reasonable period and then, failing that, terminate the contract: you are then refunded every sum paid, within fourteen days at the latest. If the country of destination charges import duties or taxes, they remain payable by the recipient.

5. Right of withdrawal

You have fourteen days from receipt of the map to withdraw, without having to give a reason for your decision or to bear any costs other than those set out below (Code de la consommation, art. L.221-18). You may also withdraw as soon as the order is placed, before receipt.

How. Inform us before the end of the period, using the form below or by any other unambiguous statement, at [email protected] or by post to 6 rue d'Armaillé, 75017 Paris, France (art. L.221-21).

The return. Send the map back, in its tube, to 6 rue d'Armaillé, 75017 Paris, France, within fourteen days of your decision at the latest. The direct cost of returning it is yours to bear. You are liable only for any diminished value resulting from handling other than what is necessary to establish the nature and the characteristics of the map (art. L.221-23).

The refund. We refund every sum paid, delivery included, within fourteen days of your decision at the latest, using the means of payment you used. We may withhold the refund until the map has been recovered or until you have supplied proof that it has been dispatched, whichever of these happens first (art. L.221-24). A credit note is sent to you.

The exception. The right of withdrawal does not apply to a map bearing a title you have written yourself: it is clearly personalised and cannot be sold to anyone else (art. L.221-28, 3°). This case is pointed out before payment, on the order page and on Stripe's page. Choosing a country, a map style, languages or a format from our options does not take this right away. The legal guarantees in section 6 remain unaffected in every case.

6. Legal guarantees

The seller is liable for any lack of conformity existing when the map is delivered and appearing within two years (art. L.217-3); one appearing within twenty-four months is presumed to have existed at delivery (art. L.217-7). A map that arrives damaged, badly printed or different from the order is reprinted and sent again free of charge: write to us at [email protected] with a photograph.

The consumer has two years from delivery of the goods to obtain the benefit of the legal guarantee of conformity where a lack of conformity appears. During that period, the consumer need only establish the existence of the lack of conformity, and not the date on which it appeared.

Where the contract of sale of the goods provides for the supply of digital content or a digital service on a continuous basis for more than two years, the legal guarantee applies to that digital content or that digital service throughout the period of supply provided for. During that period, the consumer need only establish the existence of the lack of conformity affecting the digital content or the digital service, and not the date on which it appeared.

The legal guarantee of conformity requires the trader, where applicable, to supply all the updates necessary to keep the goods in conformity.

The legal guarantee of conformity gives the consumer the right to have the goods repaired or replaced within thirty days of his request, free of charge and without major inconvenience to him.

Where the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

Where the consumer asks for the goods to be repaired but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and be refunded in full against return of the goods, where:
1° The trader refuses to repair or replace the goods;
2° The repair or the replacement of the goods takes place after a period of thirty days;
3° The repair or the replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;
4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to rescission of the contract where the lack of conformity is so serious as to justify an immediate price reduction or an immediate rescission of the contract. The consumer is then not required to ask for the goods to be repaired or replaced beforehand.

The consumer is not entitled to rescission of the sale where the lack of conformity is minor.

Any period during which the goods are out of use with a view to their repair or their replacement suspends the guarantee period remaining to run, until the repaired goods are delivered.

The rights set out above arise from the application of articles L. 217-1 à L. 217-32 du code de la consommation.

A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (article L. 241-5 du code de la consommation).

The consumer also benefits from the legal guarantee against hidden defects, under articles 1641 à 1649 du code civil, for two years from the discovery of the defect. That guarantee gives the right to a price reduction if the goods are kept, or to a full refund against return of the goods.

7. What you may do with the map

The map you have bought can be hung, looked at, given away and lent. Its reproduction, its resale as a model and any commercial use remain subject to permission: see the legal notice.

The data used to compute the maps are published under open licences, whose attributions are printed on each map. Any rights holder who considers that an element of a map infringes their rights may write to [email protected]: the map concerned is withdrawn from sale as promptly as possible while the claim is examined.

8. Your data

What the order records, who receives it and for how long: see Personal data.

9. Complaints and mediation

Any complaint should be addressed first to [email protected].

If the dispute is not settled, you may refer the matter free of charge to the consumer mediator, within the year following your written complaint:

10. Liability

The seller is responsible for the proper performance of the sale under the conditions laid down by law. It cannot be held liable for damage resulting from any use of the map other than the decoration, reading and learning for which it is intended, in particular where you rely on it to find your way, to navigate or to establish a legal or administrative fact.

The seller is released from all or part of its liability if it proves that the non-performance or improper performance of the contract is attributable to you, for example where the delivery address is wrong, or is due to the unforeseeable and insurmountable act of a third party unconnected with the supply, or to force majeure within the meaning of article 1218 of the French Civil Code (French Consumer Code, art. L.221-15).

Where the buyer is a business — school, library, company —, the seller's liability, for all causes combined, is limited to the price paid for the order concerned and does not extend to indirect loss, such as loss of turnover, customers or data, save in the event of gross negligence or wilful misconduct.

Nothing in these terms limits or excludes the rights you derive from mandatory provisions of law, in particular the legal guarantees in section 6, nor the seller's liability for personal injury or for gross negligence or wilful misconduct.

11. Governing law

These terms are governed by French law. If you live in another country, you keep the protection afforded to you by the mandatory provisions of its law. In the event of a dispute, you may bring proceedings before the court of the place where you were living at the time of the order or when the harmful event occurred.

If any clause of these terms is held to be void or unenforceable, it shall be deemed unwritten, and the remaining clauses shall remain in full force.

The seller keeps every successive version of these terms and will send you, on simple request to [email protected], the one that applied to your order.
